Are you selling cosmetic products into Europe?
The primary piece of legislation governing cosmetic products in Europe is the Cosmetics Regulation (EC) No. 1223/2009. Each cosmetic product placed on the European market must have a designated Responsible Person (RP) located in the European Economic Area (EEA). The RP of the cosmetic products must ensure that it is in compliance with the legislation.
Following Brexit, the UK will be considered a third country and economic operators located in the UK will no longer be considered to be established within the EU Community. Responsible Persons established in the UK will not, as from the withdrawal date, be recognised as the Responsible Person for the purposes of the Cosmetics Regulation (EC) No. 1223/2009. Manufacturers of cosmetics must designate a natural or legal person established within the EEA to act in the capacity of RP if they wish to continue to distribute in the EEA.
Following discussions with the Health Products Regulatory Authority in Ireland (HPRA) we have received approval from them which allows cosmetic companies to establish an Irish company which will assume all the responsibilities of the RP. As a result we have tailor made a particular service which allows cosmetic companies to locate their RP in Ireland.
